TERMS OF SERVICE

1. Purpose and Acceptance of These Terms

These Terms of Service, referred to as the Terms, govern your access to and use of Giantticket.world, including the content, functionality and services offered on or through Giantticket.world, referred to as the Platform.

Please read these Terms carefully before using the Platform.

By using the Platform, creating an account, or clicking an option through which you accept these Terms, you acknowledge that you have read, understood and agreed to these Terms, together with the Refund Policy and Privacy Policy applicable to the Platform.

If you do not agree to these Terms, you must not access or use the Platform.

Certain features, activities or uses of the Platform may be subject to additional policies. Where such policies are expressly incorporated into these Terms, they form part of these Terms.

The Platform is intended for users who are 13 years of age or older. Persons under the age of 13 must not use the Platform.

By using the Platform, you represent that you have the capacity required to use the services offered and to comply with the obligations contained in these Terms.

The original language of these Terms is English. Any translation that may be made available is provided for convenience only.

2. Definitions

For the purposes of these Terms, the following definitions apply.

Buyer means any user who purchases a service through the Platform.

Business Account means an account that allows multiple authorised users to collaborate for business purposes where such functionality is available.

Business Account Team Member or Team Member means any person who is authorised to use a Business Account.

Custom Offer means a service offer created by a Seller in response to specific requirements submitted by a Buyer.

Custom Order means an Order that results from the acceptance of a Custom Offer.

Ticket Extra means an additional service offered alongside a Ticket for an additional price.

Ticket Package means a structured version of a Ticket that allows a Seller to offer different service levels, deliverables, formats or prices.

Ticket Page means the page on which a Seller describes a Ticket, its characteristics, conditions and price, and on which a Buyer may place an Order.

Ticket or Tickets means services offered for purchase on the Platform by Sellers.

Order Page means the area of the Platform used by the Buyer and Seller to communicate in connection with an Order.

Order or Orders means the transaction and agreement resulting from the purchase of a Ticket or acceptance of a Custom Offer.

Seller or Sellers means any user who offers or provides services through Tickets on the Platform.

User means any person who accesses or uses the Platform, including Buyers and Sellers.

3. General Platform Principles

Only registered users may buy or sell services through the Platform.

Registration is free unless otherwise stated in connection with a particular service or feature.

Sellers may determine the price of their Tickets, subject to any limits, rules or commercial conditions applicable on the Platform.

Buyers make payments using payment methods offered or approved by the Platform.

An Order may be created through the purchase of a Ticket or acceptance of a Custom Offer.

Fees, payments, refunds and related financial matters are governed by these Terms and the applicable Refund Policy.

Sellers must fulfil their Orders in accordance with the commitments made to Buyers.

Repeated cancellations, poor performance, violations of these Terms or abusive conduct may affect a Seller's status or access to the Platform.

The Platform may establish different levels, statuses or classifications for Sellers based on activity, performance or reputation.

Users must not offer or accept payment outside payment methods authorised by the Platform where the transaction originated through the Platform.

4. 90-DAY MONEY-BACK GUARANTEE

All Tickets purchased directly through our websites are covered by our 90-DAY MONEY-BACK GUARANTEE.

If you are not satisfied with your purchase, you may request a refund within 90 days of the original purchase date.

Subject to the terms set out in these Terms and the applicable Refund Policy, an eligible refund will be returned using an appropriate payment method.

The 90-DAY MONEY-BACK GUARANTEE applies to all Tickets purchased directly through our websites.

5. Refund Processing and Possible Delays

Our 90-DAY MONEY-BACK GUARANTEE means that an eligible customer retains the right to a refund when a valid refund request is made within the applicable 90-day period.

In some circumstances, we may be unable to complete or settle a refund immediately.

Refund processing may be affected by circumstances outside our direct control, which can include banking procedures, payment processor requirements, card scheme rules, compliance checks, enhanced due diligence, fraud prevention reviews, transaction limits, verification requirements or temporary restrictions imposed by a financial institution.

Where such circumstances arise, the existence of a processing delay does not, by itself, remove an eligible customer's entitlement under the 90-DAY MONEY-BACK GUARANTEE.

We may require additional information or verification before a refund can be processed.

We may also use an appropriate alternative refund method where the original payment method cannot reasonably be used.

Eligible refunds will be processed as promptly as reasonably practicable. We will communicate with the customer where a material delay affects completion of the refund.

6. User Accounts

Users must provide accurate, complete and current information when creating and maintaining an account.

Each User is responsible for maintaining the confidentiality of their login credentials and the security of their account.

A User is responsible for activity conducted through their account unless such activity results from circumstances that were reasonably outside their control.

Any unauthorised use or suspected compromise of an account should be reported as soon as reasonably possible.

Users must not create accounts using false identities, misleading information or information belonging to another person without proper authority.

Identity, payment, security or compliance verification may be required where reasonably necessary.

7. Sellers

Sellers create Tickets to offer services to Buyers.

Sellers may also offer Custom Offers where such functionality is available.

Sellers must provide accurate and sufficiently clear descriptions of the services they offer.

Sellers must provide the services and deliverables described on their Ticket Pages or agreed through a Custom Offer.

Revenue resulting from an Order may be credited to the Seller's account in accordance with the applicable payment terms.

The Platform may deduct applicable fees, refunds, cancellations, chargebacks, adjustments or other amounts due before funds become available for withdrawal.

Seller ratings may be calculated using reviews, Order history, cancellations, delivery performance and other activity relating to the Seller.

A Seller's ability to withdraw funds may be temporarily restricted for reasons involving security, fraud prevention, compliance, payment processing or investigation.

Each Seller is responsible for obtaining any licences, insurance, professional authorisations or other permissions required to provide their services.

8. Tickets

Sellers may publish Tickets within the limits applicable to their account or status.

Tickets published on the Platform constitute User Generated Content.

Tickets may be removed, suspended or restricted where they violate these Terms, Platform rules or any applicable policy.

Prohibited Tickets may include services or content involving:

  1. Illegal or fraudulent activity.

  2. Copyright, trademark or other intellectual property infringement.

  3. Violations of third party rights.

  4. Prohibited, pornographic or obscene content.

  5. Intentional copies of Tickets belonging to other users.

  6. Deceptive or fraudulent content.

  7. Spam or abusive activity.

  8. Prohibited or regulated goods or services where their offering on the Platform is not permitted.

  9. Services relating to academic fraud or misconduct.

  10. Services that cannot reasonably or lawfully be offered through the Platform.

  11. Services that repeatedly demonstrate an insufficient standard of quality.

  12. Activity that violates applicable laws, regulations or third party rights.

  13. Activity that may harm the Platform, its Users, payment providers or partners.

A Ticket removed for violation of these Terms may not be eligible for restoration.

Tickets may also be removed from search results because of poor performance, policy violations, identified risks or inappropriate conduct.

Sellers must provide services that correspond materially with the descriptions, images, examples and representations contained on the Ticket Page.

Statements contained on a Ticket Page must not contradict or attempt to circumvent these Terms.

9. Ticket Extras and Ticket Packages

Ticket Extras allow a Seller to offer additional services related to the main service.

Ticket Extras are subject to the same rules that apply to Tickets.

Services offered as Ticket Extras must be reasonably related to the relevant Ticket or Order.

The Platform may limit the number, type or price of Ticket Extras available.

Ticket Packages may allow Sellers to offer different service levels, quantities of deliverables or prices.

10. Buyers

Buyers must review the description, price, conditions, requirements and other information relating to a Ticket before placing an Order.

Buyers must provide Sellers with information, documents, instructions and other materials reasonably required to complete an Order.

Buyers must use payment methods offered or approved by the Platform.

Buyers must not attempt to circumvent the Platform by making direct payments to a Seller for services where the commercial relationship originated through the Platform.

Buyers must not request illegal, fraudulent, prohibited or abusive services.

Buyers must behave appropriately when communicating with Sellers and other Users.

11. Orders

An Order is created when a Buyer successfully purchases a Ticket or accepts and pays for a Custom Offer.

The Ticket Page, Custom Offer, Order Page, agreed deliverables and relevant communications may form part of the terms applicable to the Order.

The Seller is responsible for completing the Order in accordance with the requirements agreed with the Buyer.

The Buyer is responsible for providing information or materials reasonably required to complete the Order.

Any delay caused by missing information, instructions, approvals or materials from the Buyer may affect the expected delivery date.

An Order may be considered completed when the relevant services or deliverables have been provided and the Order has been marked or treated as completed through the Platform.

The Platform may establish additional procedures concerning delivery, acceptance, revisions, completion or cancellation of Orders.

12. Cancellations, Refunds and Disputes

Refund requests are subject to the 90-DAY MONEY-BACK GUARANTEE, these Terms and the applicable Refund Policy.

Requests may be reviewed individually, taking into account the circumstances of the Order, services provided, communications between the parties and other relevant information.

A refund may be approved in full or in part where appropriate.

Where an Order is cancelled or refunded, amounts credited to the Seller in connection with that Order may be reversed, reduced or adjusted.

Where a Seller has already received funds relating to an Order that is subsequently refunded, charged back or reversed, the relevant amount may be recovered or deducted from amounts that would otherwise be payable to the Seller.

The Platform may assist Buyers and Sellers in resolving disputes and may require the parties to provide information, documents or other relevant materials.

13. User Conduct

Users must use the Platform lawfully and in good faith.

Users must not:

  1. Engage in fraud, deception or misrepresentation.

  2. Harass, threaten or abuse another User.

  3. Impersonate another person or organisation.

  4. Distribute spam, malware or harmful content.

  5. Interfere with the operation or security of the Platform.

  6. Access or attempt to access accounts, systems or data without authorisation.

  7. Manipulate reviews, ratings, Orders or Platform activity.

  8. Use multiple accounts to circumvent restrictions or security measures.

  9. Circumvent payment systems applicable to transactions initiated through the Platform.

  10. Use the Platform for illegal or prohibited purposes.

  11. Infringe the rights of another person.

Suspected violations may be investigated and may result in appropriate action.

14. User Generated Content

Users may publish, transmit or otherwise make content available through the Platform.

Each User remains responsible for the content they provide.

By publishing or transmitting content, the User represents that they possess the necessary rights, permissions and authorisations.

Users must not publish content that infringes intellectual property rights, privacy rights or other rights belonging to third parties.

Content that violates these Terms or applicable policies may be removed or made inaccessible.

By providing content to the Platform, the User grants the rights reasonably necessary to host, display, reproduce and technically process that content for the purpose of operating, protecting, improving and promoting the Platform.

15. Ownership of Delivered Work

Unless otherwise stated on the Ticket Page, in a Custom Offer or in another agreement between the Buyer and Seller, rights in work specifically created and delivered for a Buyer will transfer to the Buyer once the Order has been completed and all amounts due have been paid.

The Seller may retain ownership of tools, methods, templates, software, processes, resources or other intellectual property that existed before the Order or that was not created specifically for the Buyer.

Where pre-existing material belonging to the Seller is incorporated into delivered work, the Seller grants the Buyer the rights reasonably necessary to use the delivered work for its intended purpose, unless different licence terms were communicated before purchase.

Content belonging to third parties remains subject to the applicable rights and licences of those third parties.

16. Platform Intellectual Property

The Platform, its technology, design, software, text, graphics, trademarks, logos, interfaces and other proprietary materials are protected by applicable intellectual property rights.

Except where expressly authorised, Users must not copy, reproduce, modify, distribute, sell, license, disassemble or commercially exploit proprietary elements of the Platform.

The Giantticket.world name, logos and visual identity must not be used without permission.

17. Confidentiality

Buyers and Sellers may receive confidential or private information in connection with an Order.

Such information must be used only for the purpose for which it was provided.

Confidential information must not be disclosed to third parties unless disclosure is authorised, reasonably necessary to complete the Order or required by law.

Information that is already publicly available without violation of these Terms will not be considered confidential.

18. Reviews and Ratings

Buyers may be permitted to publish reviews concerning Sellers and Orders.

Reviews must reflect genuine experiences and must not contain fraudulent, misleading, abusive or prohibited content.

Users must not manipulate reviews or offer improper incentives in exchange for favourable ratings.

The Platform may remove reviews that violate these Terms or applicable policies.

19. Suspension and Termination

An account may be restricted, suspended or terminated where reasonably necessary because of:

  1. Violation of these Terms.

  2. Fraudulent or suspicious activity.

  3. Security risks.

  4. Payment disputes or chargebacks.

  5. Abusive conduct towards the Platform or other Users.

  6. Illegal or prohibited activity.

  7. Repeated violations of Platform rules.

  8. Attempts to circumvent Platform systems.

  9. Risk to the Platform, its Users, payment providers or partners.

Certain account functions may be temporarily restricted while a particular situation is reviewed.

Where reasonably practicable, the affected User may be notified of a significant account restriction.

Suspension or termination of an account does not remove obligations concerning completed Orders, outstanding payments, refunds, chargebacks, intellectual property rights, confidentiality obligations or other obligations that, by their nature, are intended to continue.

20. Third Party Services

The Platform may contain links to third party services or use services provided by payment providers, financial institutions, technical providers or other external service providers.

The Platform does not control independent services provided by such third parties.

Use of third party services may be subject to the separate terms and policies of the relevant provider.

21. Disclaimer of Warranties

The Platform provides an online environment through which Buyers and Sellers may interact and transact.

Except where a service is expressly provided directly by the Platform, Sellers remain responsible for the services they offer and provide.

The Platform does not guarantee that every Ticket will meet the specific expectations or requirements of every Buyer.

The Platform may occasionally be unavailable or interrupted because of maintenance, technical problems, third party services or circumstances reasonably outside our control.

Nothing in these Terms is intended to exclude any obligation or liability that cannot lawfully be excluded.

22. Limitation of Liability

To the fullest extent permitted by applicable law, the Platform will not be liable for indirect, incidental, special or consequential losses arising from use of the Platform or transactions between Buyers and Sellers.

The Platform will not be liable for losses arising from circumstances reasonably outside its control, including interruptions or difficulties involving financial institutions, payment service providers, telecommunications providers, hosting providers or other third parties.

Nothing in this section limits liability that cannot lawfully be limited or excluded.

23. Indemnification

Each User is responsible for their use of the Platform and for the services, content and materials they provide.

To the fullest extent permitted by applicable law, the User agrees to indemnify the Platform against claims, losses, liabilities, damages and reasonable costs arising from unlawful use of the Platform, violation of these Terms, infringement of third party rights, or services and content provided through the Platform.

24. Changes to These Terms and General Provisions

These Terms may be updated from time to time.

Updated versions may be published on the Platform together with a revised effective date.

Where a change is material, additional notice may be provided through the Platform, by email or through another reasonable communication method.

Continued use of the Platform after updated Terms become effective constitutes acceptance of those Terms, subject to any rights that cannot lawfully be excluded or waived.

These Terms, together with the Refund Policy, Privacy Policy and any other policies expressly incorporated into them, constitute the agreement governing use of the Platform.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

Failure to enforce a provision of these Terms does not constitute a waiver of the right to enforce that provision later.

Headings are included for convenience and do not affect interpretation.

Words in the singular may include the plural where appropriate, and words in the plural may include the singular.

Rights and obligations that, by their nature, are intended to continue after account closure or termination will remain in effect.

Refunds Policy

Giantticket.world want you to be happy with your services purchase from us. However, if you are not completely satisfied, we would sincerely like to understand what went wrong with your order.


In such cases and where possible, we will credit your Giantticket.world account or refund the full monetary value of the service, subject to the below terms.

Giantticket.world

reserves the right to assess and credit or refund clients on a discretionary case by case basis.

This is acknowledged pre-purchase of “Giantticket.world” services that are in some cases services are reliant on the delivery of third-party suppliers (where Giantticket.world simply serves and an intermediary service to a third-party supplier).

Service Delivery Failure

In such cases where a third-party service provider has failed to deliver or short-delivered on an order, Giantticket.world would reserve the right to review the case and source a new supplier to deliver the requested service before refund or credit is issued.

Transaction Fees and Duties

Transaction charges levied between suppliers in the operation of some web services may carry transaction costs and “handling fees” or in most cases, these transactions are embedded into the product sales price and are not refundable.

Quality of Service

Giantticket.world makes no guarantee whatsoever on the output of services delivered as part of its service offering. Reporting on services provided is limited to the output delivery and NOT its effectiveness in the marketplace where there are many variables beyond our control. Goods and services are delivered as stated and not subject to refund or credit without management approval.

Vouchers & Coupons

Vouchers and coupons are not eligible for refund or credit under any circumstances. There are two methods on Giantticket.world used to issue “promotional” vouchers and coupons. These funds are virtual and not representative of monetary value.

Balance Refunds

Credit balance refunds are refundable in circumstances whereby a client wishes to close their account with Giantticket.world in such cases please email [email protected] with an account refund and cancellation request. Funds are transferred back to assigned bank accounts from date of our bi-monthly supplier payment cycles and refunds are NOT issued immediately. Please NOTE: ID verification as well as other precautionary measures will need to be requested and furnished in order to validate the account holders payment details.

Refunds Prior to A Service Delivery

Cancellation on the part of Giantticket.world, 3rd Party supplier or the account holder will result in the full purchase price being refunded to the account holders credit balance on Giantticket.world Cancellation is no indicative of due monetary refund and is usually automatic.

Other Refunds and Liability

By default Giantticket.world reserves the right to hold credit funds in good faith for service delivery on behalf of account holders. In the event that there is a dispute in relation to a service provided from this platform Giantticket.world limitation of liability extends only to the value of the services willingly and electively purchased via the Giantticket.world platform.

Platform Abuse

In good faith we provide a range of marketing and promotional services. Account holders that abuse our services or attempt to exploit Giantticket.world systems or use Giantticket.world systems to exploit services are subject to having immediate account closure without refund in reserve of all due rights.

These rights include the

  • Circumvention of Giantticket.world payment platforms to solicit suppliers in our network (strictly prohibited).

  • Bring reputational harm to the Giantticket.world brand or service offering.

  • Any direct violation of the terms of agreement on registering with Giantticket.world

Privacy Policy

Giantticket.world respects your privacy.

Giantticket.world does not sell, rent, or give any identifiable personal information regarding its members to any third party unless the member has subscribed to such services on his/her own. Any information that you give to us is held with the utmost care and security.

Giantticket.world will work with our partners, such as advertising agencies, content providers, to bring you relevant information that pertains to your interest categories, and thus some of your information may be shared with such parties. However all companies that we work with will also be bound by our privacy statement.

You will never receive any unwanted email or postal mail as a result of information you have given to Giantticket.world. And you can opt-out or unsubscribe to any lists or announcement categories at any time by following the procedures set forth by Giantticket.world.

When you register as a member at Giantticket.world, you must submit your name, email address, and your website information so that we can properly set up your account and send you the relevant information that you have requested or subscribed to.

Giantticket.world will not collect any personal information about individuals except when specifically and knowingly provided by such individuals. Examples of such information are name, postal address and email address. Giantticket.world may share non-personal aggregate, or summary, information regarding its customers with partners or other third parties, but Giantticket.world does not sell or share any information at the individual customer level unless the individual customer has subscribed to receiving such information.

By registering as a member at Giantticket.world, you agree to accept this privacy policy and are aware that our policy may change at any time. This policy will always be available to users on this page for members to read.

What personal data we collect and why we collect it

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymised string created from your e-mail address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service Privacy Policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Giantticket.world Payment Terms

Please read these Payment Terms carefully before making or receiving payments through the Site. By making or receiving payments through the Site, you accept and agree, on behalf of yourself, your employer, or any other entity, if applicable, to be bound by and to abide by these Payment Terms. These Payment Terms are supplemental to Giantticket.world’s general terms of service, the “Terms of Service”.

Key Terms

Capitalized terms used but not defined herein shall have the respective meanings given to them in the Terms of Service. Giantticket.world Balance is the aggregated amount of your Revenue as a Seller, returned payments from canceled orders as a Buyer, and/or your Giantticket.world Business Balance, as defined in the Giantticket.world Business Terms. Payment Services Providers are service providers that provide payment services to Buyers and Sellers in connection with the Giantticket.world platform, including the collection of funds from Buyers in connection with purchases, the remittance and withdrawal of funds to Sellers, currency exchange services in connection with payments and withdrawals in local currencies, and the holding of funds in connection with Giantticket.world Balances. Revenue is the money that Sellers earn from completed orders and can either withdraw or use to make purchases on Giantticket.world, subject to these Payment Terms.

Receiving Payments

General

Each Job Ticket that you sell and successfully complete credits your account with net revenue equal to 80% of the purchase amount.

Each Logo Design that you sell through the Logo Maker credits your account with net revenue equal to 80% of the Basic Logo Package price and 20% of the margin above the Basic Logo Package price.

Giantticket.world credits Sellers once an order is completed. See the “Orders” section in the Terms of Service for the definition of a completed order.

If an order is canceled for any reason, the funds paid will be returned to the Buyer’s Giantticket.world Balance.

Sellers are responsible for paying any direct or indirect taxes, including GST, VAT, or other applicable taxes, which may apply to them depending on their residency, location, or the billing information that they provide in their account settings. Sellers represent and warrant that they comply, and will comply at all times, with their obligations under the income tax provisions in their jurisdiction. The price shown on the Job Ticket page or the Logo Maker order page includes all such taxes and charges that may apply to Sellers.

Appointment as Limited Payment Collection Agent: The Seller hereby appoints Giantticket.world as the Seller’s limited authorized payment collection agent solely for the purpose of accepting payments, via its Payment Services Provider, if applicable, from the Buyer and remitting those payments to the Seller. The Seller agrees that payment from the Buyer to Giantticket.world shall be considered the same as payment made directly to the Seller. The Buyer’s payment obligation to the Seller will be satisfied upon receipt of payment by Giantticket.world, or its Payment Services Provider, as applicable, and Giantticket.world, via its Payment Services Provider, as applicable, is responsible for remitting the funds to the Seller in the manner described in these Payment Terms. If Giantticket.world, via its Payment Services Provider, does not remit any such amounts to the Seller, the Seller will have recourse only against Giantticket.world and not directly against the Buyer. The Seller agrees that Giantticket.world may describe or otherwise reflect the terms contained herein in any terms of service, receipts, disclosures, or notices, including receipts provided to Buyers, that Giantticket.world may deem necessary or prudent.

Giantticket.world partners with Payment Services Providers for the purposes of collecting payments from Buyers, transferring such payments from Buyers to Sellers, and holding funds in connection with Giantticket.world Balances. All payment services in connection with the withdrawal of funds on the Giantticket.world platform are performed by Giantticket.world’s Payment Services Providers.

Withdrawing Revenues

To withdraw your revenue, you must have an account with at least one of Giantticket.world’s Payment Services Providers for the withdrawal methods listed below. All funds eligible for withdrawal will be held on your behalf in an account with Giantticket.world’s Payment Services Provider. All payment services, including withdrawal services, will be provided by Giantticket.world’s Payment Services Provider.

Your Giantticket.world profile can be associated with only one account for each Giantticket.world withdrawal method. A Payment Services Provider withdrawal account can be associated with only one Giantticket.world profile.

Revenues are made available for withdrawal from the Revenue page only after a safety clearance period of 14 days from the date on which the order is marked as complete. Top Rated Sellers are eligible to withdraw revenue following a safety clearance period of 7 days from the date on which the order is marked as complete. For Giantticket.world Studio Members, the safety clearance period depends on the Studio Lead’s Level Status or classification, such as Level 1, Top Rated, or Pro.

Sellers may withdraw their revenues using one of Giantticket.world’s withdrawal options. See the Withdrawal Methods section below for applicable payment terms. To withdraw your available revenue, you must select the designated withdrawal provider to initiate the withdrawal process.

For security reasons, Giantticket.world may temporarily disable a Seller’s ability to withdraw revenue to prevent fraudulent or illicit activity. This may result from security issues, improper behavior reported by other users, or the association of multiple Giantticket.world accounts with a single withdrawal provider.

Withdrawals can only be made up to the amount available to you.

Withdrawal fees vary depending on the withdrawal method.

Withdrawals are final and cannot be undone. We will not be able to reverse the process once it has begun.

In certain cases, Sellers may withdraw Revenues in several different currencies. All currency exchange services in connection with such withdrawals are performed by Giantticket.world’s Payment Services Providers. Your Giantticket.world Balance is always derived from its US$ value. Therefore, the local currency amount of your Giantticket.world Balance may change daily in accordance with exchange rate fluctuations and may also include conversion fees. Sellers always have the option to withdraw Revenues in US$.

Sellers will be able to withdraw their revenues from disabled accounts after a safety period of 90 days following full verification of ownership of the account in question. The 90-day period begins on the date of the last cleared payment received in the account, and any withdrawal remains subject to Giantticket.world’s approval.

Purchasing

General

Buyers pay Giantticket.world to create an order from a Seller’s Job Ticket page or Custom Offer by using the Order Now button or through the Logo Maker. Giantticket.world partners with Payment Services Providers for the purposes of collecting all payments from Buyers, transferring such payments from Buyers to Sellers, and holding funds in connection with Giantticket.world Balances. All payment services in connection with the collection of funds on the Giantticket.world platform are performed by Giantticket.world’s Payment Services Providers.

Giantticket.world serves as the Seller’s limited authorized payment collection agent solely for the purpose of accepting payments, via its Payment Services Provider, if applicable, from the Buyer and remitting those payments to the Seller. The Buyer’s payment obligation to the Seller will be satisfied upon receipt of payment by Giantticket.world, or its Payment Services Provider, as applicable, and Giantticket.world, via its Payment Services Provider, as applicable, is responsible for remitting the funds to the Seller in the manner described in these Payment Terms. If Giantticket.world, via its Payment Services Provider, does not remit any such amounts to the Seller, the Seller will have recourse only against Giantticket.world and not directly against the Buyer.

In most locations, purchases on Giantticket.world can be made using one of the following payment methods: credit card, PayPal, Giantticket.world Credits, or an existing Giantticket.world Balance. Additional payment methods may apply in certain locations.

Service fees are added at the time of purchase, when you can review and accept the total amount due. These fees cover administrative costs. As of May 2018, the fees assessed on the total purchase amount are $2 for purchases up to $40 and 5% for purchases above $40.

Your existing Giantticket.world Balance will be automatically applied to your next purchase.

You may not offer to pay Sellers, or make payments, using any method other than through the Giantticket.world site. If you have been asked to use an alternative payment method, please report it immediately to Customer Support here.

To protect against fraud, unauthorized transactions, such as money laundering, claims, or other liabilities, payment information in connection with withdrawals is collected by either Giantticket.world or Giantticket.world’s Payment Services Providers. Payment Services Providers may also collect other information as necessary to process withdrawal payments. Giantticket.world does not have access to the payment information provided to Payment Services Providers, and this information is subject to the privacy policy that applies to the relevant Payment Services Provider. By using any payment method and/or providing payment details to make purchases on Giantticket.world, you represent and warrant that: (a) you are legally authorized to provide such information; (b) you are legally authorized or have permission to make payments using the payment method or methods; (c) if you are an employee or agent of a company or person that owns the payment method, you are authorized by that company or person to use the payment method to make payments on Giantticket.world; and (d) such actions do not violate any applicable law.

Purchasing through Giantticket.world Logo Maker

All Logo Designs have a fixed US$ price and can be purchased either as the “Basic Logo Package” or as additional packages, as indicated on the Logo Design order page.

Before completing an order, you will be able to preview a watermarked version of the Logo Design embedded with your brand name and further modify the Logo Design using the editing tools. Once payment has been made, orders for Logo Designs may not be canceled.

In addition to the Logo Design package that you choose, you can purchase redesign services from the Seller who created the Logo Design. The price of such redesign services is determined by the Seller, and a service fee will be charged solely for the additional redesign services. For cancellations of logo redesign services, please refer to the “Disputes and Cancellations” section below.

Local Currencies

You can pay on Giantticket.world in several different currencies. Unless stated otherwise, you will be charged in the currency displayed on the payment page. All currency exchange services in connection with payments in local currencies are performed by Giantticket.world’s Payment Services Providers. In certain cases, when particular currencies are not supported by certain payment methods, you will be charged in US$ even if the price is displayed in another currency. In all cases, the amount that will actually be charged, in the applicable payment currency, will be clearly disclosed to you before you complete the payment.

All prices on Giantticket.world are derived from their original US$ prices. Therefore, non-US$ currency prices may change daily in accordance with exchange rate fluctuations and may also include conversion fees. Buyers always have the option to pay in US$ by changing their selected display currency.

If you paid for an Order in a currency other than US$ and your Order was later canceled for any reason, the amount returned to your Giantticket.world Balance would be based on the exchange rate as of the date of cancellation. Therefore, the returned amount may differ from the amount paid in local currency terms while maintaining the same US$ value.

Your Giantticket.world Balance is always valued in US$, even if it is displayed in a non-US$ currency. Therefore, if you choose to view your Giantticket.world Balance in any currency other than US$, its displayed value may change daily in accordance with exchange rate fluctuations while maintaining the same US$ value. Users always have the option to view their Giantticket.world Balance in US$ by changing their selected display currency.

Taxes

Buyers may be charged indirect taxes, such as Sales Tax, VAT, or GST, depending on the billing information provided by the Buyer and the applicable laws of the Buyer’s billing location. If no billing information is provided, such taxes may be based on the Buyer’s location and the applicable laws of that location. All indirect taxes are in addition to the price shown on the Site, and any such taxes will always be displayed to the Buyer before payment.

Buyers agree that they are responsible for complying with all tax requirements that apply to them, including any obligation to deduct or withhold taxes. For clarity, all prices and fees that appear on the Site are net amounts that will be paid after any applicable direct or indirect taxes, levies, withholding taxes, and/or deductions.

Giantticket.world Credits

In certain instances, Giantticket.world may offer you credits, referred to as “Giantticket.world Credits” or “Credits”, for promotional purposes or otherwise, to be used for purchasing Job Tickets and/or other services offered on the Site. Your available Credit balance will appear in your account. Your valid Giantticket.world Credits will be automatically applied to your next purchase and can be viewed in your order summary after you place the order. Unless stated otherwise, Giantticket.world Credits expire three months after receipt. Giantticket.world Credits serve only as an incentive to use Giantticket.world and, therefore, are not redeemable for cash, have no cash value, and are nonrefundable. Once used, Giantticket.world Credits may not be returned to your account, even if your Order is canceled. Giantticket.world Credits may be subject to additional conditions and restrictions, which will be disclosed to you upon receipt of the Credits. Credits may be voided in the event of fraud, misuse, or violation of these Payment Terms. Giantticket.world reserves the right to modify or cancel the Giantticket.world Credits program at any time. If you or Giantticket.world deactivate or suspend your Giantticket.world account, any unused Giantticket.world Credits in your account will be forfeited.

Disputes and Cancellations

We encourage our Buyers and Sellers to try to settle conflicts among themselves. If this process fails after use of the Resolution Center, or if you encounter non-permitted use of the Site, you can contact Giantticket.world’s Customer Support department for assistance here.

Basics

Eligible order cancellations can be performed on Giantticket.world by Customer Support or through the Resolution Center for the applicable order.

Filing a transaction dispute or reversing a payment through your payment provider or bank is a violation of these Payment Terms. Doing so may result in your account being temporarily or permanently disabled. Note: Once you have filed a dispute with your payment provider, the funds will be ineligible for a refund because of our obligations to the payment provider.

If you encounter an issue related to the service provided in an order, you are encouraged to use the Site’s dispute resolution tools to attempt to resolve the matter.

Giantticket.world, through its Payment Services Provider, reserves the right to cancel orders or place funds on hold in connection with any suspected fraudulent transactions made on the Site.

Any transfer or assignment of intellectual property to the Buyer shall be subject to full payment, and the delivery may not be used if payment is canceled for any reason.

If an order is canceled for any reason, the funds paid will be returned to the Buyer’s Giantticket.world Balance.

Revisions to deliveries can be made by Sellers based on the Seller’s Job Ticket and customer care terms. Sellers may determine the number of revisions that they wish to offer, including no revisions.

Requests for revisions can be made through the Order Page while the order is marked as Delivered.

Using the Request Revisions button to request services from Sellers beyond the agreed requirements is not allowed.

Order Cancellations

Giantticket.world encourages Buyers and Sellers to resolve service disputes mutually using the Resolution Center.

Dispute Resolution Policy

This Policy sets out the dispute process followed when a Buyer and Seller who have used any of our Payment systems elect to use the Dispute Resolution process to resolve a dispute between them.

Both parties to the Dispute case can elect to have their dispute arbitrated by GiantTicket’s internal Dispute Team. The role of the Dispute Team extends to taking all actions necessary to resolve the case in an impartial and evidential manner. You acknowledge that the verdict of the Dispute Team is final, binding, and irreversible.

Big Ticket Buyers

Once a dispute is opened, a Buyer is given 14 days to respond to it. Otherwise, they will automatically lose the dispute and the pending will be transferred to the Seller's account.

GiantTicket Sellers

Once a dispute is opened, a Seller is given 4 days to respond to it. Otherwise, they will automatically lose the dispute, and the pending amount will be returned to the Buyer's account.

Dispute Resolution Process

Stage 1 - Identify the issue

The complainant should select the Project and the payment or payments to be disputed. A User could contest all the Milestones related to a single project in one dispute.

After which, a description of the issue and an explanation of why the dispute is being opened should be given. From this stage until Stage 3, users are encouraged to attach any files that could support their claims.

Finally, the complainant is requested to enter the amount he or she is prepared to pay for the Project (if a Buyer) or wish to get paid for the Project (if a Seller). The amount could be between 0 and the total amount of the Payment(s) in question.

Stage 2 - Negotiation

At this stage, either party can negotiate for partial compensation, or (after a period of time) choose to have Freelancer's Dispute Team arbitrate the dispute. Both parties will have the opportunity to tell their side of the story and also negotiate terms to resolve the issue between themselves.

Only the party who originally filed for the dispute can cancel the dispute. If the issue cannot be resolved through negotiation, either party can choose to pay the Arbitration Fee to have the dispute arbitrated by the Dispute Team. The Arbitration Fee will be refunded if the dispute is either settled through mutual agreement or cancelled before reaching arbitration.

Stage 3 - Final Offers and Evidence

After one of the involved parties has paid the Arbitration Fee, the other party has 4 days to also pay the fee. Either party still has the option in this period to negotiate with the other party.

If the responding party does not pay the arbitration fee within the 4 days, the result will be in favour of the party who escalated the dispute into arbitration first.

If a solution is found before the responding party pays the fee, the party who paid the Arbitration Fee will be refunded this fee.

Stage 3 is the last stage where both Users can submit their final evidence to support their case. After Stage 3, the involved parties are no longer allowed to submit evidence. The dispute will be resolved based upon the evidence provided through the Dispute System, or that is otherwise available to the Dispute Team, such as the project description and correspondence between the parties.

Once the dispute has proceeded to Stage 4, further evidence will no longer be accepted.

Stage 4- Arbitration

At Stage 4, the Dispute Team will review all evidence and other information provided to reach a decision. Dispute verdicts are final, binding, and irreversible. The party who wins the dispute will be refunded their Arbitration Fee.

In the event that one of the parties of the Dispute has paid the Arbitration Fee, the other party will be given 4 days to pay the Arbitration Fee to move into Arbitration, and failure to do such will close the dispute by default, in favour of the party who initiated stage 4, with the arbitration fee initially paid refunded.

Requirements for Your Dispute

Should you elect to have the Dispute Team arbitrate your dispute, you agree to allow the Dispute Team to read all correspondence made on the Site and download or access, and test (if necessary), all uploaded files, programs, and websites related to the dispute for the sole purpose of having your dispute resolved.

You are encouraged to submit all the documents that would support your claims on your dispute.

Submit e-mail correspondences as screenshots or as *.eml files. If submitting screenshots, ensure that the "To", "From", and the "Date" bar is visible. E-mail correspondences sent in *.txt or *.doc or any word processing software will not be honoured. For proof of external correspondence, users should provide screenshots of their entire unedited conversation.

Online conversations should be submitted as screenshots of the conversation from the software used (Skype etc). 

Provide the products, contracts, and other files relating to the project and the dispute.

GiantTicket.world will retain the confidentiality of the project and the privacy of the involved users and will not release the collected information to any party unless required by law.

Fee

The fee for a dispute is $10.00 USD or 7%, whichever is greater, payable by each party. The fee will then be refunded to the winner of the dispute.
